By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.
You must be at least 13 years old to use the Services. The current MVP experience may not require you to create an account. If you choose to provide an email address or otherwise create credentials in the future, you agree to provide accurate information and keep that information secure.
You may use the Services only in compliance with these Terms and all applicable laws. You agree not to misuse the Services, interfere with their operation, or attempt to access them using unauthorized means.
You retain ownership of any content you upload or submit to the Services ("User Content"). You grant us a limited, non-exclusive license to use, process, store, and display User Content solely as necessary to operate, improve, secure, and provide the Services.
Subject to your compliance with these Terms, you own the content generated for you through the Services based on your inputs ("Output").
We may use Output on a limited, non-exclusive, royalty-free basis to operate, maintain, improve, secure, and support the Services, including for research, development, quality assurance, compliance, and abuse prevention. If we want to use Output in public-facing marketing in a way that reasonably identifies you, we will seek permission separately.
You agree not to use the Services to generate, upload, or distribute content that is unlawful, infringing, defamatory, harmful, or otherwise violates applicable law or third-party rights.
You are responsible for ensuring that you have the rights, permissions, and consents needed to upload photos or other content of yourself, other people, pets, or property.
Certain features of the Services may require payment now or in the future. Payments are processed by third-party payment processors. We do not store or process payment card information directly.
Fees, billing cycles, and subscription terms will be disclosed to you at the time of purchase. All payments are non-refundable unless required by law or expressly stated otherwise.
The Services, including all software, designs, trademarks, and branding (excluding User Content and Output), are owned by or licensed to us and are protected by intellectual property laws.
If you believe that content available on the Services infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA). We will respond to valid notices as required by law.
We may suspend or terminate your access to the Services at any time if you violate these Terms or if we discontinue the Services. Upon termination, your right to use the Services will cease.
The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services.
These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration on an individual basis, except where prohibited by law.
We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
